Prometheus Burning versus The Digital Millennium Copyright Act (DMCA)
Dear Friends... remember the email that a certain someone sent us recently? The one that called us a "huge disappointment to her" and a "follower type", etc, because we removed her from our "myspace top friends"? Yes, we know many of you remember because so many commented and emailed us showing support for the reply that we made public. We thank you and appreciate the support. It's good to know we are not alone with our opinion on the matter. But for those of you that missed it, let us break it down for you... We removed her after we heard from multiple friends and sources about her trying to sneak into this years Providence Noise (Forced) Festival without paying, eventually getting in anyway only to harass and haggle the artists that were performing, and then ultimately trying to sell her CD-R of garbage along with the other artist's merchandise. When Ben Terrorfakt (who was working the merch table at the time) said "no" because she was not a performer of the festival, she threw a little hissy fit tantrum like a spoiled brat, accusing Ben Terrorfakt of not "supporting the scene"... That's a lot of balls full of pure moron ejaculate right there. We strongly disagreed with her actions, and thus removed her from our friends list because we do not want to show support for someone who acts this way. We posted the ridiculous email she sent us following our removal of her in its entirety, along with our prompt and concise response on our website and blogs.
Upon seeing our reply, she sent us multiple requests to take it down. She said she was drunk when she sent it to us and didn't mean it anymore. Feeling that this was not a valid excuse, we ignored her hollow apology and left it online. So a couple of days later, we find in our inbox an email from her mother, asking us to take it down while making excuses for her daughter. Yes... little miss "DIY Industrial Punk Rocker Poser Girl" got her Mommy after us. Not really caring about what her Mommy's biased opinion of the matter is or her bullshit justifications for her daughters immature actions, we continued to leave the email and our reply online... until today.
You will notice that the post is currently gone. Why? Because last night we were asked to remove it by LiveJournal because they received a complaint that our post was in violation of the Digital Millennium Copyright Act (DMCA). Yes folks... the DMCA. The DMCA that pretty much everyone and anyone that is even a little bit of a Punk, Cyberpunk, Hacker, Rivethead, Electronic Artist, Electronic Musician, Hip-Hop producer, Critic, Computer Scientist, Free Speech Activist, Writer, Blogger, P2P user, MP3 user, have come to know, despise, and stand against. Apparently little miss "DIY Industrial Punk Rocker Poser Girl" and her Mommy filed a complaint saying that the email we posted is copywritten material protected by the DMCA. Instead of taking responsibility for her own actions, she is instead trying to censor the truth, sweeping it under the rug so she can go on trying to make people believe that she is something shes not.
We are currently in the process of consulting with our attorney and filing a DMCA Counter-Notification stating that we are NOT in violation. Once filed, little miss "DIY Industrial Punk Rocker Poser Girl" will have 10 days to decide weather or not she wants to take it to court... which we sincerely hope she does. According to our lawyer's opinion, she doesn't have a prayer. The E-Mail was written by her, and thus belongs to her, but we were NOT publishing it for profit, commercial gain, or slander. The material we posted was not altered in any way. It was the entire email she sent us. If she would have bothered to study the copyright laws concerning "Electronic Messaging", she should know that what we did falls under the Fair Use Limitation... we posted another authors work, in the form of criticism, and gave the original author credit.
Until this DMCA issue is handled, we are required to take down the accused material. We have complied and took down the post containing the email for now. If and when our DMCA Counter-Notification gets accepted, we will be able to re-post it. If it goes to court, we will fight it. If we lose, then I suppose you will never see the post again, and she will get away with not having to take responsibility for herself again. We just want to let everyone know the TRUTH, and why the post has been taken down for now, giving everyone an update about our current chapter of Stupid Internet Drama. We appreciate all the feedback and support on this matter so far.
As to those that currently support little miss "DIY Industrial Punk Rocker Poser Girl", we suggest you take a step back and take a hard long look as to Who and What you are actually supporting... because beneath the surface of her played out unoriginal facade, you will simply find a hypocritical talentless hack. A lonely wannabe with no musical skill, desperate for attention but unwilling to work hard enough to earn it. A self-proclaimed "DIY artist" that steals every concept from her so called "influences", depends on other producers to make her music and videos, and never gives credit where credit is due. A spoiled brat that doesn't know how to take responsibility for her own actions, still depending on Mommy to wipe her ass for her every time shes done making a mess of herself. It is pathetic.
